ELIGIBILITY: The Rock Cellar Magazine “Def Leppard Tickets/Meet-And-Greet” Contest (the “Contest”) is open only to (1) Rock Cellar Magazine fans, who are eighteen (18) years of age or older at the time of entry. Participants MUST be a resident of the continental United States of America. Residents of Alaska or Hawaii are not eligible for this contest. Any entries from non-US citizens will be disqualified. Participation in this Contest constitutes Entrant’s (defined below) full and unconditional acceptance of these Official Rules and the decisions of Sponsor, including the interpretation of these Official Rules and its exercise of discretion, which will be final and binding in all respects. Void where prohibited by law. Employees of Rock Cellar Magazine (“Sponsor”) and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies, distributors and other prize suppliers (collectively, the “Contest Entities”), directors, officers, and each of their immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to enter or win. For purposes of this Contest, immediate family members are defined as spouse, domestic partner, parents, legal guardians, in-laws, grandparents, siblings, children, and grandchildren. You must have a valid e-mail address to enter.
ENTRY PERIOD: The Contest begins on Friday, March 10, 2017 and ends on Monday, March 27, 2017 (the “Entry Period”).
HOW TO ENTER: To enter, sign up for Rock Cellar Magazine’s e-mail newsletter via any of the subscription options on the site. You may sign up on our pop-up, our subscription page, or our contest page. You will need a valid e-mail address to enter and you may only enter once. If you do not complete the required instructions, your entry will not be entered into the Contest drawing or eligible for a prize. Entrant must submit a valid e-mail to be officially entered in the Contest and eligible for a prize. The Contest Entities are not responsible for Entrant’s failure to complete their entry form on time.

Limit of one (1) entry per person, will be accepted. Subsequent attempts made by the same individual to submit multiple entries by using multiple or false contact information or otherwise may be disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Contest at Sponsor’s sole and absolute discretion. All materials submitted become the property of Sponsor and will not be returned. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. For purposes of this Contest, an online entry is “received” when the Application’s servers record the entry information. Proof of sending (such as an automated computer receipt confirming entry or “thanks for entering” message) does not constitute proof of actual receipt of an entry for purposes of this Contest. The Application’s database clock will be the official timekeeper for this Contest.
CONDITIONS OF ENTRY: As a condition of entry into this Contest, each Entrant warrants and represents that: (a) Entrant has entered true/valid information; (b) Entrant is a US citizen of one of the 48 contiguous states (Alaska and Hawaii prohibited); (c) information entered is Entrant’s own information; (c) Entrant is eighteen (18) years of age or older. As a condition of being selected a winner in this Contest , the winner irrevocably grants Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to use winner’s name in press mentions, Facebook, Twitter and other social media sites, blogs, and/or websites (without limitation as to when or to the number of times used), as well as to use winner’s likeness, and/or statements regarding his/her participation in this Contest (with or without using the winner’s name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the winner or any other party. Winner waives privacy/publicity rights or other legal or moral rights that might preclude the Sponsor’s use of the submission, and agrees not to sue or assert any claim against the Sponsor for the use of the Submission or winner’s likeness or statements. Entrant agrees to indemnify and hold the Contest Entities, and each of their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the “Released Parties”), harmless from and against any and all claims, damages, expenses, costs (including reasonable attorney fees) and liabilities (including settlements), brought or asserted by any third party against any of the Released Parties due to or arising out of the Entrant’s entry in the Contest, or the Entrant’s conduct in creating an entry or otherwise in connection with this Contest, including, but not limited to, claims for trademark infringement, copyright infringement; violation of an individual’s right of publicity or right of privacy; or defamation. Entrant further agrees to release the Released Parties from and against any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of Sponsor infringes Entrant’s rights with regard to any elements, characters or ideas contained in any submission.
SUBMISSION FORMAT AND CONTENT REQUIREMENTS: All required instructions from Rock Cellar Magazine during the entry process must be completely filled out and submitted for consideration. The person named must be the person who fills out the form and that will be deemed the entrant (“Entrant”). In the event of dispute regarding the identity of an Entrant, dispute will be resolved in favor of the individual who is the “authorized e-mail account holder” of the e-mail address provided when the e-mail user account was created provided that person is otherwise eligible. “Authorized e-mail account holder” is defined as the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization (i.e., business, education institution) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If there are multiple Entrants in one family, it is required that each Entrant submit their own entry with their own unique e-mail user account. Each Entrant must submit their own entry, including their own real e-mail address.
SELECTION OF WINNER: Six (6) winners will be randomly selected on or around March 27, 2017: One (1) lucky winner will win a pair of tickets to a concert of their choice on the Def Leppard tour, and along with their guest they will also meet Def Leppard at the show; additionally, five (5) lucky runners-up will receive a copy of Def Leppard’s brand-new DVD/CD package And There Will Be A Next Time—Live From Detroit, courtesy of Eagle Rock Entertainment. Sponsor will have complete discretion over interpretation of the Official Rules, of administration of the Contest, and of selection of the winner. Decisions of the Sponsor as to the selection of the winner will be final. The Released Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information. Potential winner will be notified via e-mail by the Sponsor and also announced on the Rock Cellar Magazine Facebook page (www.facebook.com/RockCellarMagazine) and on the Rock Cellar Magazine Twitter page (http://twitter.com/rockcellarmag).
The potential winner may be required to submit an affidavit of eligibility / release of liability / prize acceptance agreement (collectively, the “Affidavit”) and return the Affidavit within the time period specified at notification before being eligible to receive his or her prize. If the potential prize winner fails or refuses to sign and return such Affidavit within the time period required by Sponsor or if the prize or prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential prize winner, such potential prize winner may be disqualified and an alternate may be selected. Non-compliance shall result in disqualification and award of the prize to an alternate winner. Parents or legal guardians of any potential prize winner under the “Age of Majority” in his/her state of residence (which is eighteen  in most states but is nineteen  in Alabama and Nebraska and twenty-one  in Mississippi) may be required to also sign the Affidavit in order for the potential prize winner to be qualified to receive their prize. If the potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules, or if the potential prize winner cannot attend or participate in any portion of the prize, or declines a prize for any reason prior to award, such potential winner may be disqualified and an alternate potential winner may be selected. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. The prizes are non-transferable, with no cash redemptions, equivalents or substitutions except at Sponsor’s sole and absolute discretion. All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide the winner with their prize, the Sponsor may elect, to provide winner with the approximate value of such item in cash or award an alternate prize of comparable or greater value. In the event a prize winner and/or his or her guests engage in behavior that (as determined by Sponsor or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE). Prize winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes he/she receives, regardless of whether it, in whole or in part, is used. The approximate retail value (“ARV”) of the prizes is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winner may be required to provide Sponsor with a valid social security number or tax identification number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winner, or if a minor in the jurisdiction in which he/she resides, in the name of his/her parent or legal guardian, for the actual value of the prizes received. Unclaimed prizes will be forfeited.
The Prize cannot be converted into a cash prize. Prize must be accepted as awarded. There is no cash or credit redemption for the prize.
GENERAL CONDITIONS: If for any reason the Contest is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion to cancel, modify or terminate the Contest. Further, Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) submitting more than one entry form with the same address; (b) tampering or attempting to tamper with the entry process or the operation of the Contest or any Sponsor; (c) violating the Official Rules; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Released Parties are not responsible for any changes or unavailability of the entry platform that may interfere with the Contest (including any limitations, any restrictions, or any conditions on Sponsor’s ability to use the platform for the Contest as set forth herein that are not acceptable to Sponsor) or ability of Entrant to timely enter, receive notices or communicate with Sponsor, in which case Sponsor, in its sole discretion, may terminate or modify the Contest.
The Released Parties are not responsible for the actions of Entrants in connection with the Contest, including Entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest. Persons found tampering with or abusing any aspect of this Contest, or whom Sponsor believes to be causing malfunction, error, disruption or damage may be disqualified. Additionally, any attempt to cheat the Contest, as determined at the sole and absolute discretion of Sponsor, may result in immediate disqualification of the Entrant, as well as other possible consequences, including disqualification from any and all existing and future Contests. ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING THE CONTEST WEBSITE AND SOCIAL MEDIA PAGES) OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, at its sole and absolute discretion, to disqualify (or terminate the prize of) any individual who is found to be, or suspected of, acting in violation of these Official Rules, or to be acting in an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.
LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor or Contest Entities resulting from any user’s participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with participating in the Contest. No responsibility or liability is assumed by the Sponsor or Contest Entities for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; error or limitation of any Internet service providers, servers, hosts or providers; garble, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions. Winner releases Sponsor and its agents from all claims and damages associated with the use of the prize, including injury and/or death. In the event Sponsor is prevented from continuing with the Contest by any event beyond its control, including, but not limited to: fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Contest by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force majeure” event or occurrence) Sponsor shall have the right to modify, suspend or terminate the Contest. Sponsor additionally reserves the right, in its sole and absolute discretion, to modify, suspend or terminate the Contest should causes beyond Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Contest.
By participating in the Contest, Entrants agree to release, discharge and hold harmless the Contest Entities from and against any and all claims, liability, costs, losses, damages or injuries of any kind arising out of or related to Entrants’ participation in the Contest and/or related to any prize (including, without limitation, losses, damages or injuries to Entrant’s or any other person’s equipment or other property, or to their persons, related to participation in the Contest; or arising out of any violation of rights of publicity or privacy, or claims of defamation or portrayal in a false light; or based on any claim of infringement of intellectual property; or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Contest activity and/or prize). Without limiting the generality of the foregoing, Entrants agree that Contest Entities: (A) have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Contest and/or with respect to prizes, including, without limitation, to any prize’s quality or fitness for a particular purpose; and (B) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience or other irregularity that may be caused or contributed to: (1) by the wrongful, negligent or unauthorized act or omission on the part of the prize suppliers or any of their agents, servants, employees or independent contractors, (2) by any defect in or failure of any vehicle, equipment, instrumentality, service or product that is owned, operated, furnished or otherwise used by any of those prize suppliers, (3) by the wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Contest Entities, and (4) by any cause, condition or event whatsoever beyond the control of the Contest Entities. Entrants agree and that the Contest Entities shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by Sponsor; interruption or inability to access the Contest Website or Sponsor or affiliated entities’ respective websites, or any online service via the Internet due to hardware or software compatibility problems; any damage to participant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Contest; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or malfunctions, even if caused by the negligence of the Contest Entities. Each Entrant further agrees to indemnify and hold harmless the Contest Entities and Facebook, Inc. from and against any and all liability resulting or arising from the Contest and to release all rights to bring any claim, action or proceeding against Contest Entities and hereby acknowledge that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize supplier that may be sent along with a prize. Sponsor is not responsible for the actions of Entrants in connection with the Contest, including Entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Contest.
ENTRY INFORMATION AND CONTEST COMMUNICATIONS: As a condition of entering the Contest, winner gives consent for Sponsor to obtain and deliver his/her name, address and other information to third parties for the purpose of administering this Contest and comply with applicable laws, regulations and rules. Any information Entrants provide to Sponsor may be used to communicate with Entrant in relation to this Contest or on a Contest winner’s list. The Contest Entities are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant’s e-mail account and/or phone to receive e-mail and/or text messages.
DISPUTES/JURISDICTION: Each Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California. The parties each agree to finally settle all disputes in the exclusive jurisdiction and venue of the courts located in Los Angeles County, California.
